General Sales Conditions

Article 1 : Purpose

This contract concerns the sale of trademark products on the Internet and is between TRIOR company and the final individual buyer (excluding persons acting outside of their professional activity) within a distance sales framework. The resale of products purchased on the Internet site is strictly forbidden. Only professionals who clearly identify themselves upon registration are authorized to resell.

Article 2: Applicable law

This contract refers to the French law and, more particularly, to the rules concerning home shopping.

Article 3 : Offer

The order is accepted and confirmed by data provided in successive screen pages. This data appears on a summary screen which explicitly indicates the buyer's firm commitment. Orders are confirmed by email with indication of TRIOR's identity and details, including an email address to which the buyer may direct any complaints. The confirmation email includes a basic description of the item, the price including or excluding taxes, the existence of retraction rights and their explanation, after sales service and commercial guarantees.

Article 4 : Offer pricer and shipping charges

The delivery is made to the address indicated on the delivery slip, filled in by the buyer. The delivery address must be a physical address (N / street). TRIOR reserves the right to refuse any deliveries to a post office box.

For the France, the shipping will be carried out by Colissimo-suivi or Cronopost. For the other countries, the shipping will be ensured by International Colissimo (signature required for delivery + integrated Insurance). For these countries, TRIOR is obliged to quote prices excluding local import tax on its web site and is unfortunately unable to inform you about customs charges which you will have to settle upon reception of the goods. For these countries, the prices indicated on the site are based on departure from Paris, but do not include import tax. The import taxes are to be settled by you upon arrival of the goods.

Article 5 : Currencies

Invoices will be issued in EURO or USD depending on the delivery and payment location: In EURO for the European Economic Community, in USD outside of this area.

Article 6 : Payment

By credit card via Paypal or check.

Article 7 : Shipping

Between 48 hours and 72 hours following payment by card, 48 to 72 hours following the reception of a postal order. Approximately 6 to 7 days following reception of check

Article 8 : Delivery delays

TRIOR uses "La Poste-Collissimo-suivi" delivery services for France. The average delivery time is 2 to 3 working days. For the other countries TRIOR uses the International Colissimo (signature required for delivery + integrated Insurance) service offered by the post office. The average delivery delay is 4 to 15 working days depending on the destination. Nevertheless TRIOR will not be held responsible for delivery delays due to "La Poste-Collissimo" or "Chronopost" services.

Article 9 : Non-conformity of goods delivered

If the goods delivered do not conform to the order (as specified in the confirmation email), TRIOR shall put the order right or reimburse the total cost (including re-shipment charges).

Please send an email or a fax informing TRIOR of the error must be sent to our customer services within one month from the date of receipt of the package.

Article 10 : Satisfied or reimbursed guarantee 

If, for any reason, you are not satisfied, you can exchange goods or receive reimbursement (with the exception of shipping and re-shipping costs) by returning the articles in their original packaging within 7 working days from the date of delivery of your order (article L121-16 of the French consumer code). This 7-day deadline starts from the day of the reception of the goods and ends on the dispatch date indicated on the returned parcel. Please return goods to SARL TRIOR (55 rue des Archives, 75003 Paris, France); by the means of your choice (re-shipment charges at your own expense) within 7 days (as attested by the date on postmark) and include the delivery note and any customs documents. If you choose to exercise your retraction rights, TRIOR shall reimburse you for all amounts paid within no more than 30 dayss.

Article 11 : Guarantees and after-sales service

TRIOR guarantees that the jewelry sold does not contain the following metals: nickel and lead salts. If the product you have received is faulty, please inform TRIOR customer service by email or by fax as soon as possible. You should return the faulty goods by post as soon as possible, remembering to include the delivery slip and any customs documents. The defective article will then be exchanged (within the limits of stocks available).

If the product is not available, and in this case only, TRIOR shall reimburse you for the full amount paid within 30 days. TRIOR will not accept any products returned after more than 30 days following delivery.

Article 12 : Personal information

In placing an order, the purchaser consents to the use of their personal data in our customer database, however, the purchaser may withdraw such consent in writing or by email. In conformity with Law n. 78-17, dated 6 January 1978, the consumer has the right to access and modify this data at all times.

Article 13 : Customer services

TRIOR makes every effort to respond to any orders or complaints received by customer services as quickly as possible (at the latest within 15 days). TRIOR customer services can answer your calls or e-mails in english and in french and thanks you for using one of these languages in any communication. You can contact customer services TRIOR by three means:

- 24 hours a day by mail

- 24 hours a day by fax + 33 (0) 1 42 78 48 02 - from Monday till Friday from 8:30 am till 5:30 pm (French time).

- by phone: + 33 (0) 1 42 78 00 06.

Article 14 : Resolution

The parties agree that any differences which arise from this contract immediately or in the future shall be submitted for arbitration to the Centre de Médiation et d'arbitrage de Paris (CMAP). If the arbitration is unsuccessful, any litigation will be within the legal competence of the Paris courts.
